The Court of Appeal in Abuja has upheld a Federal High Court ruling restraining the Independent National Electoral Commission (INEC) from recognising or participating in any state congresses organised by the David Mark-led leadership of the African Democratic Congress (ADC).
In a split decision of two to one, the appellate court affirmed the judgment delivered by Justice Joyce Abdulmalik, holding that the order barring INEC from involvement in the disputed congresses remains valid.
The ruling was delivered in Abuja on Monday in the ongoing legal dispute over the legitimacy of the ADC’s leadership.
Justice Abdulmalik had, on April 29, 2026, restrained INEC from recognising or participating in any state congresses conducted by the David Mark-led faction pending the determination of the substantive suit.
By upholding the lower court’s decision, the Court of Appeal reaffirmed that INEC must refrain from recognising or participating in congresses organised by the disputed leadership until the matter is resolved.
