Canada has made its citizenship regulations for foreign-born individuals more clear, stressing that citizenship claims are based on a direct line of ancestry from a Canadian parent and the citizenship status of each individual in that chain at the time of birth.
According to the regulations, individuals who were born overseas may be granted Canadian citizenship if they can prove that their parents, grandparents, or other direct ancestors were citizens of Canada at the time the following generation was born.
The fact that citizenship can only be inherited directly from family members is a crucial prerequisite.
Aunts, uncles, cousins, and other family members who are not direct ancestors are not eligible to inherit Canadian citizenship.
Canadian immigration officials clarified that citizenship is determined by the relationship between a child and a parent who was a citizen of Canada at the time of the child’s birth in a post on Canadavisa’s online account on Friday.
According to the post, “a person born abroad to a parent who was a citizen at the time of the birth is recognized by the Citizenship Act.”
The clarification comes after legal challenges claimed that earlier restrictions on citizenship by descent improperly denied recognition to some Canadian descendants.
Some individuals who were previously deemed ineligible may now be acknowledged as Canadian citizens from birth rather than simply being granted citizenship on the application date, according to the revised regulations.Dates have a significant impact on an individual’s eligibility.
It is typically not possible for a parent who obtained Canadian citizenship after a kid was born to transfer citizenship to the child through descent.
Immigration officials also emphasized the significance of thoroughly examining every generation.
The post continued, “If your parent obtained citizenship after you were born, that citizenship does not pass to you through descent.”
Additionally, the regulations differentiate between various family relationships.
While adoption by a Canadian citizen requires a different legal procedure, marriage to a Canadian citizen does not instantly confer citizenship.
Applicants are advised to begin by identifying the oldest ancestor in their family who was born in Canada and then trace the citizenship connection forward, one generation at a time.
For those who meet the requirements, the process confirms a citizenship status they may already have held since birth.
“The certificate is just the part that confirms this status,” the post noted.
